Natural Environment and Rural Communities Bill Standing Committee A Session 21st June

During the Standing Committee session on the 21st June which dealt with the Natural England provisions, I undertook to write to you about the role Natural England could play in a case brought about by the European Commission against the British Government in the European Courts of Justice.

Natural England, along with all other Defra sponsored public bodies, would not have standing to become involved as a party or intervener in such infringement proceedings in the ECJ. It is the UK that is the party in any infraction case in the ECJ, not individual bodies or departments. Only other Member States can make submissions to the Court in such infringement proceedings.
