Note: The Agricultural Holdings Act 1986 consolidated certain enactments relating to agricultural holdings. Hence, references in these rules to "the 1976 Act" and "the 1984 Act" should be read as references to the relevant sections of the 1986 Act.

AGRICULTURE

The Agricultural Land Tribunals (Succession to Agricultural Tenancies) Order 1984

Made 26th July 1984
Laid before Parliament 16th August 1984
Coming into Operation 12th September 1984

The Lord Chancellor, in exercise of the powers conferred on him by sections 73(3) and (4) and 108(3) of the Agriculture Act 1947 [1947 c.48; section 73(3) and (4) was amended by the Agriculture Act 1958 (c.71), Schedule 1, paragraph 3], after consultation with the Council on Tribunals as required by section 10 of the Tribunals and Inquiries Act 1971 [1971 c.62], hereby makes the following Order:-

Citation and commencement
    1. This Order may be cited as the Agricultural Land Tribunals (Succession to Agricultural Tenancies) Order 1984 and shall come into operation on 12 th September 1984.

Rules of procedure
    2. The rules set out in the Schedule to this Order shall apply to any proceedings before Agricultural Land Tribunals arising from any application made after the commencement of this Order under Part II of the Agriculture (Miscellaneous Provisions) Act 1976 [1976 c.55; Part II of the Act was amended by the Agricultural Holdings Act 1984 (c.41), section 3 and Schedule 1] or under Schedule 2 to the Agricultural Holdings Act 1984 [1984 c.41].

Variation of the Agricultural Land Tribunals (Rules) Order 1978
    3. The Agricultural Land Tribunals (Rules) Order 1978 [SI 1978/259] shall be varied by inserting at the end of article 2 thereof (rules of procedure) the words "or under Schedule 2 to the Agricultural Holdings Act 1984".

Revocation
    4. The Agricultural Land Tribunals (Succession to Agricultural Tenancies) Order 1976 [SI 1976/2183, amended by SI 1978/259] is hereby revoked except to such extent as may be necessary for the disposal of an application pending at the commencement of this Order.
