Explanatory note: The Reporting of Prices of Milk Products (England) Regulations 2008
This note is to inform stakeholders that The Reporting of Prices of Milk Products (England) Regulations 2005 will be revoked and replaced (for reasons of clarity and better regulation) to update references to Community legislation by the above Statutory Instrument (SI) which came into force on 1 July 2008.
The SI makes no changes of substance to existing legislation.
Council Regulation (EC) No 1234/2007 (the Single CMO Regulation) repealed Council Regulation (EC) No 1255/1999 (the common organisation of the market in milk and milk products) on 1 July. As Council Regulation 1255/1999 is quoted in the title of Commission Regulation 562/2005, and the 2005 Regulations, the 2008 Regulations update the reference to Commission Regulation 562/2005 to make it ‘ambulatory’ (enabling future amendments to that Regulation to be caught by the 2008 Regulations without the need for further updating). The 2008 Regulations also add a footnote explaining the effect of Council Regulation 1234/2007 on Commission Regulation 562/2005. Similarly, to improve clarity, the 2008 Regulations add definitions of “milk processor”, “milk products”, and a ‘standard’ provision relating to corporate offenders for enforcement purposes.
A formal consultation was conducted in early 2007 on changes to the Community legislation, and no concerns relating to the dairy legislation were raised. As the changes have been reflected in the EU legislation it is necessary to make this SI solely to update references to the amending EU legislation. In these circumstances a further consultation would serve no useful purpose.
An Impact Assessment has not been prepared for this SI, as no impact on the private or voluntary sectors is foreseen. However an Impact Assessment for the changes in the Community legislation has been tabled.
