Explanatory note: The Drinking Milk (England) Regulations 2008
This note is to inform stakeholders that both the 1998 Drinking Milk Regulations as amended will be revoked and replaced (for reasons of clarity and better regulation) by the above Statutory Instrument (SI) which came into force on 1 July 2008.
The Regulations give power to enforce the EU rules (which are directly applicable) relating to the marketing of drinking milk (e.g. the descriptions used, what can be added to milk etc).
This SI makes no change of substance to the rules relating to drinking milk.
The remaking of these Regulations is required to replace references in the 1998 Regulations to Council Regulation (EC) No 2597/97 (laying down additional rules on the common organisation of the market in milk and milk products for drinking milk) which was repealed on 1 July by Council Regulation (EC) No 1234/2007 (the Single CMO Regulation).
As the 1998 Regulations applied to Great Britain, and responsibility for agriculture was devolved in 1999, it is appropriate that the 2008 Regulations cover England only. A number of references to obsolete legislation have also been removed.
A formal consultation on the draft SI was conducted between 20 March and 25 April 2008, with one response received, which agreed with the draft.
An Impact Assessment has not been prepared for the SI, as no impact on the private or voluntary sectors is foreseen. However an Impact Assessment for the changes in the Community legislation was tabled.
