Gangmasters - Exclusions from licensing

  • The supply of workers by a labour provider to undertake processing and packaging in a food retail outlet
  • The supply of workers by a labour provider to undertake processing and packaging in a catering outlet
  • The supply of workers by a labour provider to undertake processing and packaging in a retailers distribution centre
  • The supply of workers by a labour provider to undertake processing and packaging in a fresh produce, meat or fish wholesale market
  • The supply of workers by a labour provider to undertake processing and packaging in a wholesaling establishment (such as one that wholesales food to independent retailers)
  • The supply of workers by a labour provider to undertake the processing and packaging of non-food products which include a component derived from agricultural work, shellfish, fish or products thereof –this is designed to exclude workers supplied to producers of cosmetics, engine oils etc
  • Share farming arrangements (where a worker is provided to undertake work on the farm which is the subject of a share farming agreement)
  • Short term farmer to farmer loans of workers
  • Exceptional farmer to farmer loans of gang workers
  • Provision of short term agricultural services between farmers involving the supply of a worker
  • The supply of a worker by a farmer to an agricultural contractor to operate machinery supplied by that contractor for use on the farmer’s own premise
  • The supply of a worker by a sole operator appointed under the Seasonal Agricultural Workers Scheme to other scheme operators
  • The provision of sub-contract services which involve the use of labour by the sub-contractor but not the supply of labour by the sub-contractor
  • The supply of a worker as part of the provision of an agricultural machinery service by an agricultural contractor
  • The employment of workers by someone who has sold a farm but retained the ownership of a crop and uses those workers to harvest that crop
  • The supply of a qualified slaughterman to work in an abattoir
  • The supply of students by an educational establishment (such as to undertake work experience or work placement in agriculture)
  • The supply of an individual skilled worker (such as shepherds and herdsmen)
  • From 1 October 2006 the direct employment of workers to gather shellfish by a fishing vessel
