Regulation Amendment: Hazardous Waste Exports

You should read this if you have any involvement with waste exports.

Council Regulation (EC) No. 2557/2001 of December 2001, amending Annex V of Council Regulation (EEC) No 259/93 on the supervision and control of waste within, into and out of the European Community

Annex V lists waste subject to the ban on exports of hazardous waste for recovery from OECD to non-OECD countries (Article 16 of Council Regulation 259/93). This Annex has been amended by Council Regulation No. 2557/2001 (EC) which came into force in the United Kingdom as of 1st January 2002. The main reason for the changes was to reflect recent changes adopted at Community and OECD level on waste classification.

The main points are as follows. Please note that this does not replace the Regulations, it is for information only.

  • Part 1 is divided into two Lists. List A has wastes that are classified as hazardous by the Basel Convention and the export of which is banned. List B has wastes that are not covered by the export ban. This part is unchanged.
  • Part 2 has been replaced with the new list of hazardous waste adopted at Community level. This list includes a list of ALL types of waste (hazardous and non-hazardous). Waste marked with an asterisk * on this list is classified as hazardous.
  • Part 3 has been replaced with the amended OECD Appendix Part 4.

As with the previous annex it is necessary to check if a waste features in Part 1 of the amended Annex V, and if this is not the case whether it features in Part 2, and if this is not the case whether it features in Part 3.

It is important that anyone who exports wastes checks Annex V. Wastes that were previously considered non-hazardous may have been reclassified.
