Local authority waste management: Statutory duties and powers
The Waste and Emissions Trading Act 2003 (WET Act) requires local authorities in two-tier areas to have a joint municipal waste management strategy and gives waste disposal authorities a power to direct waste collection authorities.
Following a consultation in 2004, the Government issued the following:
- Guidance for Waste Authorities in Two-Tier Areas on Application of Duty to have a Joint Municipal Waste Management Strategy (PDF 60 KB) updated February 2005

- Form for application for exemption of two-tier area from duty to have in place a joint municipal waste management strategy
Local Authorities covered by the duty to have a joint strategy were obligated to have one in place by April 2005. The Government has issued a clarification (PDF 10 KB) on what is expected from Local Authorities which, under section 32 of the WET Act have a duty to have in place a joint municipal waste management strategy by this date.
