Guidance on the Landfill Allowances Schemes: Municipal Waste

This paper is intended to clarify the approach of Defra and the Welsh Assembly Government (WAG) to the waste which authorities have to report for the purposes of the Landfill Allowance Trading Scheme in England and the Landfill Allowance Scheme in Wales. In relation to England, this paper supplements the paper issued by Defra in August 2004.

In August 2004, Defra produced a paper setting out the Government's approach to the definition of municipal waste and in particular how this relates to commercial waste under the control of waste disposal and collection authorities.

This paper aims to address the concerns of local authorities expressed at the Landfill Allowance Trading Scheme roadshows held in July 2004.

Guidance on Section 26(1)(c) of the Waste and Emissions Trading Act 2003

The Secretary of State's powers to waive, and to extend the time of paying, penalties and interest are set out in this guidance.

Guidance on Section 12(3) of the Waste and Emissions Trading Act 2003

This guidance outlines the procedure for the application of penalties under section 12(3) of the Waste and Emissions Trading Act and sets out the Secretary of State's policy in relation to the exercise of her powers under section 26(1)(c).

The reconciliation period flowchart provides a simple and comprehensible outline of the six month reconciliation period that will occur at the end of each scheme year.
