Waste legislation and licensing
The Government is committed to tackling the problem of illegally deposited waste or "fly-tipping".
It is a huge anti-social problem that affects local authorities, the Environment Agency, landowners and other organisations.
Fly-tipping is a serious offence with a maximum fine of up to £50,000 in the Magistrates Court and/or 12 months imprisonment or an unlimited fine and/or 5 years imprisonment in the Crown Court.
Who does what?
Local authorities and the Environment Agency have powers to tackle the illegal deposit of waste.
Anyone who produces, transports or deposits waste is under a duty of care to ensure that the management of that waste is legal and, where appropriate, licensed by the Environment Agency. The only exception is the collection of household waste which is the responsibility of the local authority.
