Radioactivity - Exemption Orders review programme

The review is driven by the Government’s Better Regulation agenda and aims to simplify regulations on those using exemptions whilst maintaining appropriate protection to human health and the environment. The programme will ensure that the future suite of Exemption Orders:

    • are easier to follow and interpret
    • meet current legislative standards in terms of modern legal drafting requirements
    • are transparent and easier to use

Programme Board

A programme board was established to oversee the review programme initiated by Defra and the Devolved Administrations in September 2006 and the review is expected to complete April 2010. The Board aims to meet three times a year.

Programme plan

Phase I

Identify specific stakeholder concerns about the current exemption orders culminating in a major stakeholder conference (January 2007).  Phase 1 now complete.

Phase II

Identify possible options for the new suite of Exemption Orders and undertake assessment to choose the most appropriate architecture for the orders. Two workshops will take place as part of this assessment process. An informal consultation is expected on the preferred framework option in late summer 2008.

Phase III

Work drafting detailed Exemption Orders based on the preferred framework option and production of draft guidance has been completed. This draft framework has been tested in a public workshop in Edinburgh.

A formal public consultation on ‘Proposals for A Future Exemptions Regime under The Radioactive Substances Act 1993 and The Environmental Permitting Regulations 2010’ is currently underway (from 12 June to 4 September)

Phase IV

Bring the new Exemption Orders into force with associated guidance. The review is expected to complete in Spring 2010.
