Small service stations
Proposed exemption for small service stations
AQ15(03) advised that Defra was to consult on exempting from LAPC/LAPPC small petrol stations which unload into stationary storage tanks 100m³-500m³ of petrol in any 12-month period.
The current regulations require these small petrol stations to be authorised or permitted by no later than 31 December 2004 and allow applications for an authorisation/permit to be made from the end of September 2003.
It was suggested that local authorities notify any petrol station operators in these size categories, which they are aware are planning to make an application in the near future, to defer doing so pending the outcome of the forthcoming consultation.
Further guidance
The consultation paper proposals are now to be put into effect.
All service stations which unload into stationary storage tanks 100m³ - 500m³ of petrol in any 12-month period will be exempted from LAPC/LAPPC. (See regulation 2(3)(b)(iii) of the Pollution Prevention and Control (England and Wales) (Amendment) and Connected Provisions Regulations 2004, SI 3276.)
