Guidance on preparing Codes of Practice for minimising noise in England

Under section 71 of the Control of Pollution Act 1974 the Secretary of State for Environment, Food and Rural Affairs (Defra) can approve codes of practice to minimise noise. The purpose of the guidance is to set out considerations which should be taken into account and the procedures which should be followed if a code is to be submitted to the Secretary of State for approval. It is particularly important that the procedures are followed as the Secretary of State will be unable to approve a code unless she is satisfied that the necessary consultation has been carried out, especially since the courts will take into account these codes when making their decisions.

This guidance relates only to England. The National Assembly for Wales and the Scottish Executive have produced separate guidance for use in Wales and Scotland respectively. Northern Ireland will produce its own guidance in due course.
