About this guidance
Background
Under section 71 of the Control of Pollution Act 1974 the Secretary of State for Environment, Food and Rural Affairs (Defra) has powers to issue and approve codes of practice for minimising noise. Codes of practice can be prepared by the Department or non-government bodies. Currently approved Codes of Practice are listed in Appendix A.
The purpose of this guidance
In order that all codes of practice on noise are fairly considered, the Department, with the assistance of a working group established by the National Society for Clean Air and Environmental Protection, has prepared a guidance document to assist authors in their development. It sets out considerations which should be taken into account and recommends the procedures which should be followed if the code is to be submitted for approval. It is particularly important that the procedures are followed as the Secretary of State will be unable to approve a code unless she is satisfied that the necessary consultation has been carried out, especially since the courts will take into account these codes when making their decisions.
This guidance relates only to England although similar guidance may in future be issued by the Department of the Environment for Northern Ireland. The Scottish Executive and the National Assembly for Wales have produced separate guidance for Scotland and Wales respectively.
