Environmental Protection Act 1990: Code of practice on Litter and Refuse

This code is issued by the Secretary of State under section 89(7) of the Environmental Protection Act 1990 and sets out practical guidance on the discharge of the duties under section 89(1) and (2) of that Act on certain landowners and occupiers to keep specified land clear of litter and refuse, and on local authorities and the Secretary of State to keep clean public highways for which they are responsible.

It replaces the previous code, issued in 1999 by the then Department of the Environment, Transport and the Regions, and takes account of changes to litter legislation introduced by the Clean Neighbourhoods and Environment Act 2005. In addition to providing statutory guidance for those with a duty to clear litter and refuse from their land, it is intended that the revised code will assist other land managers in achieving and sustaining high local environmental quality.
