Environmental permitting - related projects

Defra and other Government departments and regulators are progressing a number of projects which potentially either impact upon EPP or are impacted by it. We are closely monitoring these to ensure a consistent and coherent approach is taken to regulation as a whole.

Most significant programmes
  • Waste Exemptions Review: interfaces with EPP as it affects which activities will need a permit or are exempt
  • Mining Waste Directive: the EP Regulations were the preferred option to transpose this EU Directive in the Government’s spring 2008 consultation. Analysis of responses is ongoing.
  • Batteries Directive: the EP Regulations may be a suitable transposition mechanism for the permitting parts of this Directive (Articles 12 (1) tailpiece, 12(2) – (4) and 14)
  • Land use planning and pollution control interface: a review is ongoing between CLG and Defra; it is intended to develop a protocol that sets out agreed ways of working.
  • Radioactive Substances Regulations (RSR) exemption orders review: interfaces with EPP as it affects which activities will need a RSR permit or are exempt.
  • Marine Bill: interactions with the EP Regulations on what needs permitting and where will need to be clearly defined
  • Floods and Water Bill: the Government proposes to publish a draft bill for consultation in 2009,  this could be used to provide a power to incorporate the  water abstraction and impounding regime into EPP2
