Enforcement review: what does it mean for me?

The Review offers new evidence-based policy ideas for improving environmental enforcement. These are at an early stage, and if they were to be taken forward further work would need to be done, particularly on assessing costs and benefits. Any significant proposals for change would be subject to formal public consultation.

You will find the report of interest if you are:

  • in a business subject to environmental regulation
  • a member of a community concerned about environmental issues
  • involved in presenting, defending or hearing environmental cases, or
  • responsible for enforcing environmental requirements.

The issues explored and the ideas for change could have significant implications for improving the enforcement of environmental regulations. The balance between criminal and administrative action, the level and impact of sentences for serious environmental crimes and the enforcement mechanisms available to regulators could all be affected.

The Review aims to support moves towards a system that is tough on serious offenders, but gives regulators the flexibility to deal proportionately with businesses that try to protect the environment.
