Delegation of Defra Responsibilities under the Land Drainage Act to the Environment Agency: Consequent Reorganisation of Flood Management Division

In late 2004, Defra commissioned a review of the current roles, responsibilities and working practices of Flood Management Division. The recommendations of that review were implemented from 1 April 2006.

The Environment Agency now has delegated powers to approve, for grant aid, flood risk management projects under the Land Drainage Act subject to obtaining Secretary of State consent for schemes over £50m. David Rooke, Head of Environment Agency's Flood Risk Management, wrote to Local Authorities and Internal Drainage Boards on 3 March 2006.

From 1 April 2006 Defra Flood Management Division will therefore be responsible for the approval of projects under the Coast Protection Act and consideration of projects under the Land Drainage Act that require Secretary of State consent. The work done in Defra is being re-organised to take account of changes.

We are now entering the second phase of the delegation to the Environment Agency of grant approvals and payment of grant for capital schemes promoted under the Coast Protection Act 1949 is expected to be completed by 1 April 2008.
