Consultation on secondary legislation for England and Wales under the Marine and Coastal Access Bill: Part 4 Marine Licensing

I am writing to invite views on some of the secondary legislation that will be made under the Marine and Coastal Access Bill, subject to its passage through Parliament.  Part 4 of the Bill provides the framework for establishing a new licensing regime to replace Part II of the Food and Environment Protection Act 1985, Part II of the Coast Protection Act 1949 and the tidal works provisions of the Electronic Communications Code.

The Bill contains a number of powers to make secondary legislation that will set out in more detail exactly how the regime will operate.

This consultation covers the approach that we should look to adopt when designing the procedure for applying for and determining a marine licence and the mechanism by which applicants can appeal against decisions of the marine licensing authority.  It also covers those activities which we should exempt from the need for a marine licence, and what restrictions and/or conditions we should place on any exemptions.

Consultation criteria

This consultation is in line with the Code of Practice on Consultations.  This can be found at www.berr.gov.uk/whatwedo/bre/consultation-guidance/page44420.html.

When this consultation ends, we will put a copy of the responses in the Defra library at Ergon House, London.  This is so that the public can see them.  Also, members of the public may ask for a copy of responses under freedom of information legislation.

If you do not want your response – including your name, contact details and any other personal information – to be publicly available, please say so clearly in writing when you send your response to the consultation.  Please note, if your computer automatically includes a confidentiality disclaimer, that will not count as a confidentiality request.

Please explain why you need to keep details confidential.  We will take your reasons into account if someone asks for this information under freedom of information legislation. But, because of the law, we cannot promise that we will always be able to keep those details confidential.
