Consultation on Article 5 of the Energy End Use Efficiency and Energy Services Directive 2006/32/EC
1. I am writing to invite views on the implementation of Article 5 of the energy ServicesDirective.2. Article 5 contains provisions that relate to the public sector, which is required to fulfil an exemplary role in the context of the Directive.
3. The Directive was agreed at the end of 2005 under the UK Presidency, and is due to be transposed by May 2008. The Directive is intended to ensure that Member States put in place targets, mechanisms, incentives and frameworks to remove market barriers and create conditions for the development and promotion of markets for energy services and other energy efficiency measures.
4. The Directive has a broad scope, covering electricity and all fuel types (except aviation and marine bunker fuels), and final customers except undertakings within the EU ETS. However within the UK, with our relatively advanced policy framework on energy efficiency and range of measures as updated in the Energy White Paper, it is expected to have a relatively restricted impact. The consultation seeks evidence on the need for any further action, beyond that currently identified.
5. Previous consultations have dealt with Articles 6 (duties on energy suppliers to promote energy efficiency measures) and 13 (metering and informative billing).
6. The consultation assesses the current energy efficiency policies in place that impact on the public sector, in order to identify any gaps in compliance with the Article’s provisions. The main proposals relate to options from an annex linked to the procurement of energy using equipment, buildings and services, from which the public sector is required to implement at least two, and whether a voluntary or legislative approach should be taken to implementation.
7. Analysis to date has identified gaps around the procurement options contained in the annex, and the assigning of an organisation to integrate the relevant policies.

Consultation Criteria
12. Please find the Cabinet Office Code of practice on Consultations. The Consultation Criteria is available at the Cabinet Office website www.cabinetoffice.gov.uk/regulation.aspx
- Consult widely throughout the process, allowing a minimum of 12 weeks for written consultation at least once during the development of the policy
- Be clear about what your proposals are, who may be affected, what questions are being asked and the timescale for responses
- Ensure that your consultation is clear, concise and widely accessible
- Give feedback regarding the responses received and how the consultation process influenced the policy
- Monitor your department’s effectiveness at consultation , including through the use of the designated consultation co-ordinator
- Ensure your consultation follows better regulation best practice, including carrying out a Regulatory Impact Assessment if appropriate
13. In line with Defra´s policy of openness, at the end of the consultation period copies of the responses we receive will be made publicly available through the Defra Information Resource Centre, Lower Ground Floor, Ergon House, 17 Smith Square, London SW1P 3JR. The information they contain will also be published in a summary of responses.
14. If you do not consent to this, you must clearly request that your response be treated confidentially. Any confidentiality disclaimer generated by your IT system in e-mail responses will not be treated as such a request. You should also be aware that there may be circumstances in which Defra will be required to communicate information to third parties on request, in order to comply with its obligations under the Freedom of Information Act 2000 and the Environmental Information Regulations.
15.
