Consultation on The Eggs and Chicks (England) Regulations 2008

1. I write to inform you of the remaking of the Eggs and Chicks  (England) Regulations and to invite any representations you may wish to make.

Background

3. The Eggs and Chicks (England)  Regulations 2008 will revoke and replace the Eggs and Chicks (England) Regulations 2007  (SI 2007 2245). They will make no changes of substance, but simply amend references to European legislation and remove the obsolete references. 

4. The Eggs and Chicks  Regulations 2007 refer to Council Regulation (EC) No 2782/75 on the production and marketing of eggs for hatching and of farmyard poultry chicks, and to Council Regulation (EC) No 1028/06 on certain marketing standards for eggs, both of  which will be repealed on 1 July by Council Regulation (EC) No 1234/2007 1. The references therefore need amendment.  The Eggs and Chicks Regulations also refer to  Commission Regulations (EC) No 1868/77 and No 557/07, which lay down  detailed rules for the implementation of the Council Regulations and which will both be repealed and replaced from July by corresponding Regulations (which have currently been adopted but not yet published in the Official Journal  of the EC). These references also will need to be amended. 

5. The Eggs and Chick (England) Regulations  2007 and 2008 apply to England.   Separate but similar legislation will be made by Wales, Scotland and Northern Ireland.  

Expected Impacts

6. The remaking of the Eggs and Chicks Regulations should have no impact, as the draft makes no policy changes and merely updates references to EU legislation.  For this reason, we have not prepared an impact assessment.

Comments

7. I would be grateful for any comments you and copy recipients may have on the attached draft Regulations.  However, we do not consider that there is much scope to amend the draft Regulations because they merely implement Community law which is directly applicable (and which has itself been subject to consultation).

1 Council Regulation (EC) No 1234/2007 was the result of a programme of work during 2007 to consolidate 21 EU Regulations which set out the framework for the Common Market Organisation (CMO) into a single Regulation (Council Regulation (EC) No 1234/2007).  The objective of the creation of this “Single CMO Regulation” was to streamline and simplify the legal framework, and increase transparency for stakeholders, without changing the underlying policies. This proposal was the flagship of the Commission’s work in 2007 on CAP Simplification.
