De-listing of Fiji for imports of fishery products

This letter is addressed to Border Inspection posts in England only.

I am writing further to my letter to you of 14 February, reference OVS/2008/12, which alerted BIPs that the EU Standing Committee on Food Chain and Animal Health (SCoFCAH) was considering de-listing Fiji for the export of fishery products to the EU.

I can now inform you that Commission Regulation 439/2008 was published in the Official Journal on 22 May 2008 and removes Fiji from the List of approved countries in Annex II of Commission Regulation 2076/2005 (as amended). Commission Regulation 439/2008 comes into force on 25 May 2008.

However, you should also note that Article 2 of Commission Regulation 439/2008 allows for a transitional period for imports of fishery products produced and certified before 25 May 2008, for a period not exceeding 6 weeks from then.

When Regulation 439/2008 takes effect, Fiji will no longer be one of the List II countries with which Member States can have a bilateral agreement for the import of fishery products. The Agency will arrange for the bilateral agreement to end as set out in paragraph (5) of the preamble to the Regulation.

We have removed from our website the list of approved establishments in Fiji for imports of fishery products, but for your use until the end of the transitional period, I attach these details as an Annex to this letter.
